Sanders. Striving for the settlement of
disputes by peaceful means

In de rijk geïllustreerde bundel Verzamelde
herinneringen', kijkt prof. mr. Piet Sanders
terug op een lang en rijkgevuld leven
als kunstverzamelaar, jurist van grote
internationale reputatie, bestuurder, mede
initiatiefnemer tot een verscheidenheid aan
instituten en kunst- en architectuurcollecties
en, buiten dit, een Schiedammer die in
hoge mate het cultureel en maatschappelijk
gezicht van deze stad heeft meebepaald.
Oorspronkelijk was het plan om aan deze
herinneringen een speciale uitgave van
Musis te wijden. Het liep echter anders.
Begrijpelijk. Op een leeftijd van 96 jaar en
nog steeds actief op het gebied van de
actuele beeldende kunst en internationale
arbitrage bestrijkt het werkzame leven van
Piet Sanders meer dan driekwart eeuw
en reikt zijn herinnering terug naar het
Schiedam waarin stalhouderij Beijersbergen
voor het wekelijks uitstapje met zijn ouders
de koets inspande. Hij vertelt daarover
met smaak en humor. Evengoed als over
zijn leerlingentijd aan het Schiedams
gymnasium waarvan de hoogste klas -
alpha en beta samen - zes leerlingen telde.
De stof die in talloze gesprekken ter sprake
kwam, was zo gevarieerd en veelomvattend
dat een boek - door hemzelf geschreven
en redactioneel begeleid door Musis- veel
meer voor de hand lag. Martien de Vletter
gaf, als verantwoordelijk uitgever voor
SUN/Boom Uitgevers in Amsterdam in
nauwe samenwerking met Musis en Piet
Sanders zelf, definitief vorm aan het project.
Eén van 's werelds bekendste juristen op
het gebied van internationale cormmerciële
arbitrage, raadgever van de Britse Kroon,
verbonden aan het hooggerechtshof van
Engeland en Wales en het voormalig
hooggerechtshof in Hong Kong en
persoonlijk vriend van Piet Sanders
schreef het volgende, op diens werk als
internationaal jurist gerichte, voorwoord.
Pieter Sanders has made his mark in many aspects of life. He is
for example, an internationally renowned collector of modern
and contemporary art. His public service of over sixty years
and his generosity are well known. Great is the respect and
affection in which he is generally held, both in the Netherlands
and elsewhere.
But it may be of interest to readers of Musis to know of
another field in which Pieter Sanders has made his mark
and where he is justifiably regarded as one of the leading
international figures. I refer to the practice of international
commercial arbitration, the primary means by which disputes
in international trade are resolved.
Arbitration of such disputes has a long history. Professor Derek
Roebuck, for example, in a series of informative articles and
books has examined arbitration in Ancient Times and in the
early Middle Ages in England. Today, essentially the same
problems arise, the same examples of conduct of commercial
matters are found, albeit in a much more complex and fast
moving world.
But it may be of interest to readers
of Musis to know of another field
in which Pieter Sanders has made
his mark and where he is justifiably
regarded as one of the leading
international figures. I refer to the
practice of international commercial

which disputes in international trade
are resolved.
International commercial arbitration is a creature of
international trade. The sixty years since the end of the Second
War have seen an unprecedented growth in the volume of
international trade and with it the number of arbitration cases.
Whole areas of the world have opened up with new economic
policies, particularly with respect to privatization and the
globalisation of international industry and business.
A few important examples suffice to illustrate the point. In
the early 1990s, India opened up its economy to overseas
investors, permitting joint ventures which have contributed to
