This is an Application to register, as a Trade Mark in respect of Spirits, a heart-
shaped label, having a border composed of the letters and words, A. C. A. NOLET,
Schiedam, frequently repeated n type so minute that a very close examination is required
to distinguish the said letters and names. About the centre of the label is a monogram
composed ot the letters J. C. S., and beneath a riband bearing the letters and name
A. A, NOLET, accompanied with representations of medals. Above the monogram are
the words «Finest Hollands Genera". The Applicant claims the right to vary the use of
those words by others in common use denoting the quality or description of spirits.
The opposition is upon the ground that the label sought to be registered is almost
identical with and lias such resemblance to the opponent's Trade Mark, registered in 1876,
and numbered 232, in respect of spirits, viz. Hollands Geneva as to be calculated to deceive.
This mark also consists of a heart-shaped label having a border of an ornamental nature.
About the centre is the device of an anchor, and beneath it is a riband containing the
name «John de Kuyper Son". Above the anchor are the words «Genuine Hollands
Geneva", as in the Applicant's label.
On behalf of the Applicant it was argued that the heart-shaped was in common
use in the Geneva trade, and that the monogram and riband as shewn upon'his label was
not calculated to deceive as compared with the opponent's device of an anchor and riband.
The opponent urged that he was the largest dealer in Geneva, that his label had
been in use for 70 years, and that the heart-shaped label had become well-known as
denoting Geneva of his manufacture.
From the evidence, it does not appear to me that the heart-shaped label has been
proved to have been in common use lor Geneva in this country, but bearing in mind that
this shape is a very distinctive feature of the opponent's Trade Mark, it appears to me,
that even if the shape of the label had been proved to have been in common use, the
Applicant would not thereby be entitled to register a new trade mark of this form, as in
Re Christiansen's trade mark (O. R., Vol. III., p. 61) it was held, in considering whether
a label composed of one distinguishing feature and several designs common to the trade
was so like another label also composed of one distinguishing feature and several designs
common to the trade as to be calculated to deceive, that it was not the two distinguishing
features alone which were to be looked at, but the labels as a whole.
And when the two labels in this case are compared not only with respect to shape,
but also with regard to the matter appearing upon them, it appears to me that the
Applicant is seeking to register in such combination a trade mark which would be calculated
to mislead the public, and I therefore refuse to proceed with the registration of the
Applicant's label.
